These Terms of Service govern your use of the CaMeSo Gardens LLC website and your purchase of products, including pre-order plants and related gardening items. By accessing our website or placing an order, you agree to these Terms of Service. If you do not agree, please do not use the website or place an order.
1. About CaMeSo Gardens
CaMeSo Gardens LLC is a small-scale gardening business offering plants and related products for local customers. Live plant orders are available for local pickup only unless a product listing specifically states otherwise.
2. Product Information
We make reasonable efforts to provide accurate product descriptions, photographs, availability information, pricing, and estimated pickup dates. However, plants are living products and may vary in size, color, shape, maturity, and appearance.
Product availability, growing timelines, and estimated pickup dates may change because of weather, pests, disease, germination rates, crop conditions, supplier delays, or other circumstances beyond our reasonable control.
An estimated availability or pickup date is not a guaranteed delivery date.
3. Pre-Orders
Pre-orders reserve a product or quantity expected to become available during the estimated timeframe stated in the product listing.
Placing a pre-order does not guarantee that a specific plant will reach a particular size, appearance, or maturity by the estimated date. If growing conditions or other circumstances affect availability, CaMeSo Gardens may provide a revised fulfillment date, offer a substitute when appropriate, or cancel and refund the affected item.
4. Pricing and Payment
Prices are displayed on the website at the time an order is placed. Applicable taxes, fees, and other charges will be shown at checkout when required.
Payment must be completed through the payment methods made available at checkout. By submitting payment information, you represent that you are authorized to use the payment method provided.
CaMeSo Gardens reserves the right to correct pricing, product, or availability errors and to cancel or refund an order affected by a material error.
5. Order Acceptance and Changes
Submitting an order constitutes a request to purchase. An order is accepted when CaMeSo Gardens confirms it or begins processing it.
We may decline, limit, or cancel an order when necessary because of product availability, pricing errors, suspected fraud, duplicate orders, technical errors, or other legitimate business reasons. If we cancel an order after payment has been received, we will issue a refund for the canceled items.
Customers should contact us as soon as possible if they need to correct an order. We cannot guarantee that changes can be made after an order has been submitted.
6. Cancellation Policy
Customers may cancel a pre-order within 24 hours of placing the order and receive a full refund to the original payment method.
After the initial 24-hour period, customer-requested cancellations are generally not accepted, except as required by applicable law or as otherwise provided in these Terms.
If CaMeSo Gardens cannot fulfill an order within its disclosed estimated availability window, the customer will be notified and offered the choice of accepting a revised fulfillment date or receiving a full refund for the affected items.
If an item becomes unavailable or cannot be produced to our quality standards, CaMeSo Gardens will issue a full refund for the affected item.
7. Local Pickup
Customers will be notified when their plants are ready for pickup and will receive pickup instructions, including the available pickup location, dates, and times.
Customers are responsible for collecting orders within the stated pickup period. If an order is not collected, CaMeSo Gardens may contact the customer to arrange an alternative pickup time. Additional handling, storage, or disposal terms may apply when an order remains uncollected for an extended period.
Customers should inspect plants promptly at pickup and notify CaMeSo Gardens of any apparent issue as soon as reasonably possible.
8. Plant Care and Customer Responsibility
Once an order has been picked up, the customer is responsible for transporting and caring for the plants. CaMeSo Gardens cannot guarantee plant survival after pickup because survival depends on factors including transportation, planting, watering, light, temperature, soil, pests, disease, and other growing conditions.
Any care instructions provided by CaMeSo Gardens are general guidance and are not a guarantee of results.
9. Refunds
Approved refunds will be issued to the original payment method. Processing times may vary depending on the payment provider.
Nothing in these Terms limits rights or remedies that cannot legally be waived.
10. Website Use
You agree to use the website lawfully and not to:
- Violate any applicable law or regulation;
- Interfere with the website’s operation or security;
- Attempt to gain unauthorized access to accounts, systems, or data;
- Submit false, misleading, or fraudulent information;
- Copy, reproduce, modify, or misuse website content without permission; or
- Use the website to harm CaMeSo Gardens or another person.
11. Intellectual Property
The website and its content, including text, photographs, logos, graphics, product descriptions, and branding, are owned by or licensed to CaMeSo Gardens LLC unless otherwise stated. You may not use, reproduce, distribute, or modify this content without prior written permission, except as permitted by law.
12. Third-Party Services and Links

To the fullest extent permitted by law, the website and its content are provided on an “as available” and “as is” basis. CaMeSo Gardens does not guarantee that the website will always be available, uninterrupted, secure, or error-free.
To the fullest extent permitted by law, CaMeSo Gardens disclaims warranties not expressly stated in these Terms, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
This section does not limit any warranty or consumer protection right that cannot legally be excluded.
14. Limitation of Liability
To the fullest extent permitted by law, CaMeSo Gardens LLC will not be liable for indirect, incidental, special, consequential, or punitive damages arising from or related to the website, an order, a product, a delay, or the inability to use the website.
To the fullest extent permitted by law, CaMeSo Gardens’ total liability for any claim related to an order or product will not exceed the amount paid for the specific product or order giving rise to the claim.
Nothing in these Terms limits liability that cannot legally be limited or excluded.

These Terms are governed by the laws of the State of Texas, without regard to conflict-of-law principles.
Any dispute arising from these Terms, the website, or an order will be handled in the courts located in Lampasas County, Texas, unless applicable law requires otherwise.
19. Severability
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will remain in effect. The invalid or unenforceable provision will be modified or applied to the minimum extent necessary to make it enforceable, if permitted by law.
20. Entire Agreement
These Terms, together with the applicable product listing, order confirmation, Cancellation Policy, Refund Policy, Privacy Policy, and other policies posted on the website, constitute the agreement between you and CaMeSo Gardens regarding your use of the website and purchase of products.
